Terms and Conditions

  1. Information on how to enter and prizes form part of these conditions of entry. Entry into the Promotion is deemed acceptance of these conditions of entry. Entry must be made online or by mail.
  2. Entry is open to Australian and New Zealand residents aged 18 years or over who fulfill all the entry requirements set out herein (“Eligible Entrant”). Employees, including all retail staff of authorised Acushnet Stockists and their immediate families, all Acushnet Australia Pty Ltd and Acushnet New Zealand Ltd. staff, printers, suppliers, providers and agencies associated with this Promotion are ineligible to enter.
  3. Entry forms are available from 500 participating outlets across Australia and 80 participating outlets across New Zealand. For a full list of participating stores please visit www.TitleistGolfBallPromotion.com.au (Australia) or www.TitleistGolfBallPromotion.co.nz (New Zealand). Breakdown of the 500 Australian Stores are: SA - 23 stores, NT - 4 stores, TAS - 5 stores, NSW - 177 stores, QLD - 87 stores, VIC - 158 stores and WA - 46 stores.
  4. The Promotion commences at 7:00am (AEST) on Saturday 4th October 2014 and concludes at 11.59pm (AEDST) on Friday 5th December 2014 (“Promotion Period”). Entries for the Minor Prize draws are accepted up until 5pm (local time) on Friday 5th December 2014.
  5. Participating Titleist Golf Ball products include: Titleist Golf Balls dozen packs in original packaging: Titleist Pro V1, Titleist Pro V1x, Titleist NXT Tour, Titleist NXT Tour S, Titleist Velocity, Titleist DT SoLo (“Participating Products”).
  6. To enter the Major, Minor or Weekly Prize Draws, an Eligible Entrant must, during the Promotion Period, purchase any Participating Product and then submit their entry by one of the following entry mechanics:
    Australian Residents:
    1. Major Prize Draw: Enter online at www.TitleistGolfBallPromotion.com.au and complete the online entry form with their full name, email address, mailing address, alternate phone number, unique code and store of purchase, or mail in their completed entry form with a copy of their purchase receipt to: ‘Win a Trip to Fiji’, PO Box 1037, Windsor, VIC 3181
    2. Minor Prize Draw: Entrants will be required to complete the perforated section of the entry form in the full manner required and hand it to the shop assistant. Entries are accepted up until 5pm (local time) on Friday 5th December 2014.
    New Zealand Residents:
    1. Major Prize Draw: Enter online at www.TitleistGolfBallPromotion.co.nz and complete the online entry form with their full name, email address, mailing address, alternate phone number, unique code and store of purchase, or mail in their completed entry form with a copy of their purchase receipt to: ‘Win a Trip to Fiji’, Po Box 5465, Mt Maunganui 3150 New Zealand.
    2. Minor Prize Draw: Entrants will be required to complete the perforated section of the entry form in the full manner required and hand it to the shop assistant. Entries are accepted up until 5pm (local time) on Friday 5th December 2014.
  7. An Eligible Entrant can only enter in their own name. The Promoter reserves the right to request proof of residency, proof of age identification (to the Promoter’s satisfaction in its discretion) and original proof of purchase before issuing a prize.
  8. Multiple entries will be accepted, subject to the following: (a) only one entry per day permitted per Participating Product purchased during the Promotion Period; and (b) each entry must be submitted separately and in accordance with entry requirements. Entrants may be requested to provide the Promoter with proof of purchase for all entries submitted. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes the original store receipt for each purchase. The Promoters decision to disqualify an entry is final and no correspondence will be entered into.
  9. Major Prize Draw: The Major Prize Draw will take place at 11.30am (AEDST) on Wednesday 10h December 2014 at Oxygen Interactive, 117 Wellington Street, St Kilda, VIC 3182. The first Eligible Entrant drawn from both the Australian and New Zealand entries received will each win the Major Prize as outlined in Condition 12. Winners will be notified by telephone, mail within 2 days and their details will be published in The Australian (AUS winner) and New Zealand Herald (NZ winner) newspapers on Wednesday 17th December. 2014.All reasonable steps to notify the winners of the draw will be taken by the Promoter.
  10. Minor Prize Draw: Each of the 580 participating outlets will conduct their own prize draw from the entries they received during the Promotion Period at 1:00pm (local time) on Saturday 6th December 2014. The first Eligible Entrant drawn in each draw will win the Minor Prize as outlined in Condition 12. Winners will be notified by telephone, mail within 2 days and South Australian minor winners details will be published in The Australian newspaper on Wednesday 17th December 2014. All reasonable steps to notify the winners of the draw will be taken by the Promoter.
  11. Weekly Prize Draw: There will be weekly prize draws, as specified in the table below. The weekly prize draws will take place at 11:00am (AEST/AEDST) at Oxygen Interactive, 117 Wellington Street, St Kilda, VIC 3182. Entries from each Weekly Draw will not roll over into any subsequent weekly draws, but will be included in the Major Prize Draw.

  12. Major Prize: The first (1) Eligible Entrant randomly drawn from Australian entries received will win:
    • Four (4) return economy airfares to Fiji (including all flight related taxes) departing from the winners nearest State of residence (ex Sydney, Brisbane, Perth, Adelaide, Hobart, Darwin, Melbourne, Canberra)
    • Transfers to/from Airport to Hotel
    • Four (4) nights accommodation based on twin/double occupancy at the Sheraton Fiji Resort, Denarau
    • $FJD1,000 Spending Money
    • A round of golf per person at each of the following golf courses: Denarau Resort and Natadola Bay
    • 4 dozen Pro V1 golf balls, 4 x Titleist Permasoft Gloves, 4 x Titleist FJ Tour Caps, 4 x Titleist Travel Covers, 4 x Titleist 22” Wheeled Duffel Bags
    Prize is valued at $AUD10,250 (RRP). The first (1) Eligible Entrant randomly drawn from New Zealand entries received will win:
    • Four (4) return economy airfares to Fiji (including all flight related taxes) departing from the winners nearest major airport (ex Christchurch, Auckland)
    • Transfers to/from Airport to Hotel
    • Four (4) nights accommodation based on twin/double occupancy at the Sheraton Fiji Resort, Denarau
    • $FJD1,000 Spending Money
    • A round of golf per person at each of the following golf courses: Denarau Resort and Natadola Bay

    Prize is valued at NZD$11,200 (RRP). The Major Prize must be taken before 31st December 2015. The Major Prize cannot be taken during these dates: *** Blackout Dates ***. All components of the Prize must be taken together. Accommodation, flights and golf course tee times are subject to availability and are at the Promoters discretion. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Travel and accommodation is to be arranged by the Promoter and/or a licensed travel agent nominated by the Promoter.
  13. Minor Prize Draw: The first (1) Eligible Entrant randomly drawn from each participating outlet will win a Titleist Cart Bag valued at $AUD349 (RRP) $NZD399 (RRP).
  14. Weekly Prize: The first (1) Eligible Entrant randomly drawn (as per clause 11) from both Australian and New Zealand web entries, will each receive a Dozen Pro V1 or Pro V1x Golf balls, valued at $AUD69.95 / $NZD84.95 . Each winner will have the ability to select either Titleist Pro V1 or Pro V1x, based on their preference. Total Weekly Prize Pool is $AUD629.55 / $NZD764.55.
  15. Total maximum prize pool value in Australia is $AUD185,379 (RRP) including GST where applicable. Total individual State prize values are: SA $18,906.55, NT $12,275.55, TAS $12,624.55 NSW $72,652.55, QLD $41,242.55, WA $26,933.55 and VIC $66,021.55.
  16. Total maximum prize pool value in New Zealand is $NZD43,884.55
  17. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries are deemed to be received at the time of receipt in the Promotion database and not at the time of transmission or postage by the entrant.
  18. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  19. Unclaimed Prize Draw: If a Major Prize winner is ineligible to receive a prize or a prize remains unclaimed, then subject to any written directions given under relevant State or Territory legislation, the Promoter may conduct such further draws as is necessary, in order to distribute the prize. Major Prize: An unclaimed prize draw will take place at the same time and location as the original Major Prize Draw on Monday 16th March 2015. In the event of any winner in the unclaimed prize draw, they will be notified by telephone, in writing within 2 days and their details will be published in The Australian newspaper and The New Zealand Herald newspaper on Monday 23rd March 2015. Minor Prize Draw: If necessary, in order to distribute the prize, an unclaimed prize draw will take place at the same time and location as the original draws on Monday 16th March 2015 and winners will be contacted by telephone, in writing within 2 days and any South Australian second chance winners will have their details published in The Australian on Monday 23rd March 2015.
  20. The Major Prize is subject to any prevailing terms and conditions of accommodation/transport/services/ transfers/ or tour providers, and in particular, health, behaviour, age and safety requirements. Each winner is responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended vaccinations and immunisations in the manner required before travelling. No compensation will be payable if a winner, is unable to use any element of the prize as stated for whatever reason.
  21. All other costs associated with the Major Prize including additional meals, additional flights, laundry services, transport to and from departure point, insurance (and any applicable insurance excesses), travel insurance, passports and visas and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winners. The Major Prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Prize are subject to prevailing terms and conditions of use and passes are only valid for use within the stated duration on the passes or vouchers issued or the duration of the winners’ holiday, whichever is earlier. Any tickets or passes which remain unused after the completion of the prize shall be deemed null and void.
  22. The Major Prize winners and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present their credit card at time of accommodation check in.
  23. Prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
  24. If for any reason any element of a prize becomes unavailable for any reason beyond Promoter’s control then a similar prize element of equal or greater value will be awarded to the winner in lieu, subject to the Relevant State Authorities.
  25. The Promoter may, at its absolute discretion, disqualify any Entrant/s and declare any or all entries made by an Entrant/s invalid if the Entrant/s:
    1. Tampers with the entry process, including the use of any automated entry software or any other mechanical or electronic means that permit the Entrant to automatically enter repeatedly; or
    2. Shares proof of purchase requirements in order to gain competitive advantage over other Entrants;
    3. Tampers with the operation of the Promotion or web site; or
    4. Is found to be using multiple aliases, household addresses or email addresses; or
    5. Acts in a disruptive manner; or
    6. Fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or
    7. Fails to produce items as required or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
    8. Acts in violation of these Conditions of Entry.
  26. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this Promotion take no responsibility for prizes damaged or lost in transit.
  27. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
  28. The Promoter assumes no responsibility for:
    • any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; or
    • any technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times; or
    • any theft, destruction or unauthorized access to, or alteration of such communications; or
    • any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; or
    • any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.
  29. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
  30. The Promotion is offered in New Zealand and Australia and is governed by the laws applicable in New Zealand and Relevant State Authorities in Australia who grant a license. In case of any disputes, participants in the Promotion consent to the jurisdiction of the courts in New Zealand and Australia.
  31. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  32. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, War; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
  33. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
  34. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Promotion. By participating in the Promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies or Promotional partners who may contact entrants with special offers in this way. By entering the Promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
